The data obtained through the carpool software for persons living or working in Flanders are jointly owned by Taxistop vzw and De Lijn (Vlaamse Vervoersmaatschappij, i.e. Flemish public transport company) in the context of a management agreement concluded with the Flemish Region.
Taxistop asbl, which has its registered office at 5030 Gembloux, Rue Buisson-Saint-Guibert 1 box b, is granted access to the data obtained via the Websites given that they too make use of the software tool.
In addition, Taxistop vzw can also make use of processors. Processors are natural persons or legal persons who process personal data on behalf of the data controller. Processors are responsible for processing personal data for the benefit of Taxistop vzw, Taxistop asbl and De Lijn and for the proper technical operation of the Websites (data transmission). The persons who are authorized to process the data under the direct authority of the controller do not belong to this group.
Of course, the person responsible for the processing is extremely careful in his selection of the processors. For example, processors must offer sufficient guarantees with regard to technical and organizational security measures regarding the processing, and comply with the obligations of Article 16, §1 of the Privacy Act.
The person responsible for the processing does not bear or take any responsibility for loss or corruption of data, identity theft, data theft, viruses or Trojan horses, SQL injections or other attacks on the computer systems or online cloud portals. Processors decide autonomously on the most technically appropriate application to process the data, and rely on their professional expertise in their choice.
Taxistop may collect anonymous or aggregated data of a non-personal nature, such as browser type or IP address, the operating system that you use or the domain name of the Websites from where you came to the Taxistop website, or through which you leave. This makes it possible to permanently optimize the Taxistop websites for the users. The surfing data will be deleted after anonymous processing but can be used to determine who is responsible in case criminal offenses have been committed through or against the Websites.
Visitors can also register via the website www.carpool.be, www.eurostop.be, the Carpool app of Taxistop or Comon app to search for carpool partners, or as an employee to use MyMobiCalendar. Taxistop registers and processes the personal data that were provided voluntarily by the user when making use of the functionalities on the aforementioned Websites and of the services offered via these Websites. The personal data registered and processed by Taxistop include names and contact details such as home address, telephone number, e-mail address, date of birth and other optional information.
With regard to the carpool app, your location is also saved. It is important to be able to determine your location exactly in order to find a suitable carpool partner in real time. Your location data will only be used for real-time searching of a carpool partner.
The personal data you provide will be used for the following purposes:
For the purposes for which the user enters the data: to exchange with potential carpoolers or to use MyMobiCalendar.
If applicable, for passing them on to the carpool coordinator with a view to processing the data in function of support and campaigns for commuting and tax purposes.
For informing the user via an electronic newsletter about matters concerning carpooling and sustainable mobility.
It is also possible that these data are used to inform the user about new facts, events and services of Taxistop or other partners and other organizations promoting sustainable mobility.
Because of the accuracy of the data on carpool.be, recurrent rides are deactivated after 6 months at the latest, unless they are explicitly extended by the person in question. He or she will receive an e-mail one month in advance with a link for renewal. The service provider offers the customer the possibility to manage files without e-mail address online to prevent automatic deactivation. Non-active rides remain in the database, but are no longer visible as an advertisement for other carpoolers.
Personal data are kept for five (5) years, because of the ease of use for a person who wants to register again. After 5 years of inactivity, these personal data will be anonymized, and this carpool file will only be retained for statistical information.
Whenever the user provides personal data, Taxistop will treat these in accordance with the policy described and the legal obligations regarding the processing of personal data.
Personal data may also be entered via a carpool coordinator from their organization on Carpool.be. The carpool coordinator then has the responsibility to ask the employee for permission and to enter the correct data and keep them accurate. He informs the person about the purpose of the data processing and the right to inspect, correct and delete data. Taxistop bears no responsibility with regard to this information that was entered by third parties. Taxistop cannot be held liable in case there is unclarity or a lack of permission or in case insufficient information has been given to the employee.
By providing their personal data via the Websites, the users of the Websites explicitly grant Taxistop permission to process these for the aforementioned purposes. This permission also includes the permission to send the (mandatory) personal data, in order to have them processed, to companies cooperating with Taxistop: De Lijn (Vlaamse Vervoersmaatschappij, i.e. Flemish Public Transport Company), Taxistop asbl, partners and other organizations promoting sustainable mobility, Google Analytics and MailChimp, i.e. software to send e-mails.
In case data are entered via a carpool platform linked to a company connection to stimulate carpooling among employees, the data are also passed on to the carpool coordinator. The employee who joins Carpool.be or MyMobiCalendar via the company gives permission to the carpool coordinator to view the personal data and work-related rides. The carpool coordinator can request these data in the context of support and campaigns related to commuting. In addition, the worker who joins Carpool.be via the company accepts that his profile is visible in the search results of the public database of Carpool.be.
Apart from the aforementioned categories of recipients, Taxistop does not pass on any personal details to third parties, unless explicitly requested by judicial authorities and in the cases where this is explicitly required by law. If Taxistop wishes to pass certain personal data on to third parties, explicit prior permission will be requested and this will be brought to the attention of the user. What is set out above also applies to the processing of personal data outside the EU.
The personal data provided via the Websites are stored and processed via an electronic system managed by Taxistop in a closed, secure environment that is not publicly accessible. These data are only accessible to an assigned number of persons employed by Taxistop vzw and Taxistop asbl who are authorized to view and process the data.
You have a legal right to inspect and, if appropriate, correct your personal data. You can also object free of charge to providing your personal data to third parties, combining your personal data into a profile, or receiving information and offers by e-mail or mail. On top of that, every informative e-mail and electronic newsletter that Taxistop sends will contain a link allowing you to unsubscribe from newsletters and the like. Taxistop can inform the user via newsletters up to two (2) years after the service was used for the last time.
